This is HOT, HOT, HOT ................. Mayor 'Moneybags' Manzi looses a big one

Lt. Wnek is already trying to pay Mayor 'Moneybags' Manzi back in a big way. Too bad Lt. Wnek does not have the competence to get an endorsement through.

Lt. Wnek attempted to get the Methuen Police Superior Officers to endorse Mayor 'Moneybags' Manzi for his re-election bid and it FAILED in a big way.

Nice try Lt.

This Just In …………………Read All About It……….

It seems that Chief Lavigne has picked Lt. Wnek to head detectives in spite of the past six months of shall we say Lieutenant to Patrolman persuasion to influence the outcome of three serious offenses involving the Lieutenants family member. I smell additional ethics violation complaints forthcoming. When will the administration stop encouraging these types of behaviors? Please see for yourself. If you would like the incidents listed below include case numbers and date, feel free to go to the PD and request a copy of all three reports. However, the Hit and Run report is m marked as a preliminary report therefore, preventing it from being printed (An old trick, that old dogs know about)

Let me recap the incidents for you:

1) 03/22/09 8:51 PM, Case # 366718, Uniform Crime Report: Assault & Battery (From the facts you will see the label should be Assault & Battery with a Dangerous Weapon)

The 20-year-old female victim reported that while jogging at the intersection of Currier and Washington St in Methuen, at approximately 5:55 pm she was struck in the left side of her HEAD, with a Wendy’s cup that had ice in it.

As a result of an investigation Lt. Wnek’s son admitted to striking the woman in the HEAD with a cup filled with ice.

A hearing was setup at Lawrence District Court for Assault & Battery.

Even though these facts constitute a felony Assault & Battery charge that normally a person would be arrested for and charged appropriately. This resulted in a Misdemeanor hearing request. I won’t even get into whom the lawyer that represented him was; I think that would be too much to swallow all at once.

Now one would think getting one break is enough, NO not in Methuen.

2) 03/23/09 9:53 PM, Case #366795, Uniform Crime Report: Assault & Battery (From the facts you will see the label should be Assault & Battery with a Dangerous Weapon, on a victim sixty or older)

Yes, readers as hard as this is to believe it happened again the next day. You would think once the police caught you on Sunday night you wouldn’t do the same thing on Monday night. Well I guess you where WRONG!

The 71-year-old male victim (YES the victim is 71-years old) reported while walking at about 5:00 PM he had a Wendy’s cup that had ice in it thrown at him and it struck him in the chin. The victim related that this happened to him also on Saturday when a Wendy’s cup full of ice was thrown at him. Later on the victim related feeling soreness in his neck.

As a result of an investigation a motor vehicle was stopped and suspects where identified and two juveniles where charged in juvenile court. (Excellent police work)

During the investigation the officer spoke with Lt. Wnek’s son in reference to the Assault by means of a Dangerous Weapon on the 71-year old victim that had occurred on Saturday. Lt. Wnek’s son stated to the officer “I was in the car and I did hit somebody with it”. He further again acknowledged throwing the cup of ice at the 71-year old victim.

This may seem unbelievable but after being caught on Sunday night for striking the female victim, Lt. Wnek’s son admitted to an Assault & Battery with a Dangerous Weapon on a victim sixty or older (This is a felony which shall be punished by imprisonment in the state prison for not more than five years or by a fine of not more than one thousand dollars or imprisonment in jail for not more than two and one-half years) and as hard as it is to believe NO charges where brought against him.

3) 09/11/09:49 PM, Case #379217, Uniform Crime Report: MV-Accident Hit & Run With Personal Injury

The 25-year old male victim reports that while traveling down Elm St in Methuen at 9:20 PM a vehicle swerved into his lane and struck his vehicle. The other MV stopped and the operator said, “There is no damage” and he drove off. The officer observed visible damage to the victim’s motor vehicle. As a result of the victim obtaining the plate number and description of the vehicle and suspect. Lt. Wnek’s son was located and he admitted to sticking the other motor vehicle.

No charges where sought (AGAIN) for leaving the scene of a motor vehicle accident, rather an accident report was filed.

It does not take a genius to see the preferential treatment that these cases received. With the reserve police officer and firefighter hiring fiasco, it is very clear that the City of Methuen has a policy of nepotism and protection of their own. It is now very clear why you would want Lt. Wnek running the detective division; no corrupt stone will ever be looked under.

Take a moment to think my loyal readers, after pondering does this not smell like a cover-up. Chief Lavigne the citizens of Methuen call upon you to take your head out of the sand and start to gain control over the rogue (sound familiar) officers who are destroying the little moral that is left. I hate to say it but the glass ceiling has been shattered and it is raining down upon all of us.

CHAPTER 265. CRIMES AGAINST THE PERSON

Chapter 265: Section 15B. Assault with dangerous weapon; victim sixty or older; punishment; subsequent offenses

Section 15B. (a) Whoever, by means of a dangerous weapon, commits an assault upon a person sixty years or older, shall be punished by imprisonment in the state prison for not more than five years or by a fine of not more than one thousand dollars or imprisonment in jail for not more than two and one-half years.
Whoever, after having been convicted of the crime of assault upon a person sixty years or older, by means of a dangerous weapon, commits a second or subsequent such crime, shall be punished by imprisonment for not less than two years. Said sentence shall not be reduced until one year of said sentence has been served nor shall the person convicted be eligible for probation, parole, furlough, work release or receive any deduction from his sentence for good conduct until he shall have served one year of such sentence; provided, however, that the commissioner of correction may, on the recommendation of the warden, superintendent, or other person in charge of a correctional institution, or the administrator of a county correctional institution, grant to said offender a temporary release in the custody of an officer of such institution for the following purposes only: to attend the funeral of next of kin or spouse; to visit a critically ill close relative or spouse; or to obtain emergency medical services unavailable at said institution. The provisions of section eighty-seven of chapter two hundred and seventy-six relative to the power of the court to place certain offenders on probation shall not apply to any person seventeen years of age or over charged with a violation of this subsection.
For the purposes of prosecution, a conviction obtained under subsection (a) of section fifteen A or paragraph (a) of section 18 shall count as a prior criminal conviction for the purpose of prosecution and sentencing as a second or subsequent conviction.
(b) Whoever, by means of a dangerous weapon, commits an assault upon another shall be punished by imprisonment in the state prison for not more than five years or by a fine of not more than one thousand dollars or imprisonment in jail for not more than two and one-half years.

I know you are a wiz at 'DOS' based computer systems but this newfangled windows systems are a bit different, let alone the forensic knowledge one needs today to be a good investigator. Sgt. Phillips Solves 1st case as the Forensics Investigator

On Thursday night while patrolling in the coveted red undercover car the Sgt turned onto High St and he had an epiphany . He immediately returned to his new office and he feverishly typed out his first report.

TO: Chief Lavigne

FR: Sgt. Phillips

SB: Violation of MPD Rules & Regulations – Dispensing Police Information

Dear Chief,

As I was aimlessly driving around tonight deciding whom I should harass I remembered that last year I met with Ellen Bahan on High St and I provided her with police department records involving members of the Methuen Police Department. Additionally I have on numerous occasions called news reporters and provided them with inside information and copies of police investigations with the intent of causing disruption to the MPD, stress and embarrassment to the members of the MPD with the hope of leading to an untenable situation (Mayor ‘Moneybags’ gave me that one). I have not stopped this undermining and I continue to report information to make the department look bad.

Having reported this to you I would also like to remind you that I have received a no discipline pass from Mayor “Moneybags” Manzi and there is nothing you can do to me. This is evident by the new position I have been assigned by Mayor "Moneybags" and by the past complaints made against me where I have not only NOT been disciplined but I received overtime to participate in the investigation and the hearings that I was the subject of. (Public information request forthcoming)

In closing please be advised that I will continue my subversive activities indefinitely, because this is what a bully does. I do however appreciate the plush position and the extra benefit of receiving a shift differential of 8%. I pledge to continue my activities of the past and I hope that they prolong the misery of everyone I work with.

Sgt. Phillips transferred to a Monday thru Friday schedule with shify differential as Captain Fram’s assistant. So in a year when the city budgets were cut by 10% and city employees received significant pay cuts the police department still has enough extra superior officers to assign an assistant to the assistant to the Chief of Police. OMG, when will this insanity end? If this can be done then there is an extra Sergeant and this position should be eliminated and the savings returned to the citizens of Methuen. The truth is this transfer is to allow the Sgt. To hunt down the Blogger full time.

Captain, remember having the Sgt. Work on tracking this Blog is definitely for your personal gain and reeks of another Ethics violation. Captain again to remind you I do not work for the city, I do not conduct business with the city and therefore you have no way of intimidating me or holding something over my head. Interestingly the Boston Globe slander lawsuit showed that even when something written is known to be untrue and it is about a public official that public official has a diminished expectation of privacy and therefore the action is unactionable (the definition for you…. not justifying a lawsuit, not actionable).

However, this doe not apply here because everything written here is accurate, true and factual.

I am starting to think that there is something wrong with the badge #’s C01 and C02; it appears to be de ja vu. Captain maybe if your ego was not so big you would have stayed with C10 and been better off.

In the words of a woman who predicted many of the goings on at the MPD, Bad Boy and Bad Girl, What You Gonna Do When They Come For You.

My Prediction: Within the next 24 hours officers will be targeted and questioned about menial issues unrelated to this Blog, with the intent of instilling FEAR and ANXIETY. Thank you for the emails and the sound bites, they were very informative.

It may be hard sometimes to play Sgt Schultz but Chief Lavigne is a natural at it. Her attendance at last night's patrolman's meeting only served to show how out of touch with reality she is. She does not have any answers, she could not provide a list of alternatives she came up with to prevent layoffs, and she attended the meeting completely unprepared and showed her lack of communication skills. She had no answers relative to the lack of equipment and she did not even know that a computer printer caught on fire!!!!

Her actions only furthered the renewal of calls for a SECOND vote of NO CONFIDENCE.

Freedom of Speech

Captain,
I suggest you review the MGL's and the Constitution of the United States next time you decide to send out an email meant to quell the ability of government workers free speech.


MGL C66 S10 (Applies to the employer and those responsibly for the public record, not to other individuals.).The relevant part of the law is below. Captain you should be well aware of what constitutes violating someone’s civil rights. You would think after being sued by Attorney Wright and losing $250,000. You would think twice before stepping outside of the law.

Although I do not condone making public a police officers address I do believe that all actions must comply with the law.


I do hope that the time Sgt. Phillips is spending in the computer forensics room is on his own time and not time being paid for by the city. His work is solely for your personal gain, which would constitute an ethics violation. Now you do not want another one so close to the last do you?
